Notice: Adoptions from Lesotho to Begin Under the Hague Adoption Convention

The Hague Convention on Protection of Children and Co-Operation in Respect of Intercountry Adoption (Convention) entered into force for Lesotho on December 1, 2012. At that time, Lesotho did not yet have a fully functional Convention process in place and elected to suspend intercountry adoptions. The Government of Lesotho notified the U.S. Embassy in Maseru that the current suspension on intercountry adoptions will cease on February 28, 2013. The United States determined that it will be able to process Convention intercountry adoptions initiated from Lesotho on or after March 1, 2013. However, please note that minor delays may be encountered while the Ministry of Social Development finalizes its structure for in-country fees, which the Ministry expects to publish in April 2013.

The Government of Lesotho also notified the U.S. Embassy in Maseru that accredited adoption service provider Small World, Inc. is now authorized to provide services in Convention adoptions from Lesotho. This is the only U.S. adoption service provider currently authorized to operate in Lesotho. Adoption service providers interested in seeking authorization should contact Lesotho's Ministry of Social Development.

The Department of State cautions U.S. prospective adoptive parents and adoption service providers that the Ministry of Social Development does not expect to publish a fee structure for in-country fees until approximately April 1, 2013. The Department of State reminds adoption service providers that, in accordance with the accreditation and approval standards, prospective adoptive parents must receive a detailed fee schedule for the entire process, including foreign country program expenses, when deciding whether to contract with a specific adoption service provider.

On November 8, 2012 the Council on Accreditation (COA) canceled the Hague accreditation of Children of Africa Enterprises/Hope Adoption Agency (“Hope”) for failing to maintain substantial compliance with the U.S. accreditation standards at 22 Code of Federal Regulations Part 96 Subpart F.  Prior to this date, Hope was a Hague accredited adoption service provider authorized to operate in both Hague and non-Hague countries.

As a result of this cancellation, Hope must cease to provide all adoption services in connection with cases covered under the Hague Adoption Convention.  This adoption service provider currently operates in Ethiopia.  Please note that according to U.S. regulations, this cancellation will not affect Hope’s ability to work in non-Hague countries.  Persons with an open case with Hope may contact the adoption service provider directly to find out whether and how the cancellation may affect your adoption services.

The cancellation of accreditation for Hope was effective on November 8, 2012. Updated information will be provided on the adoption.state.gov website.

DOS Adoption Alert: Haiti Update

Alert: Update On Haiti's New Adoption Procedures
 
This alert updates the Department of State’s September 14, 2012 notice pertaining to Haiti’s new administrative adoption procedures.

Haiti’s adoption authority, Institut du Bien-Être Social et de Recherches (IBESR), has postponed the effective date of the new administrative adoption procedures from October 1 to November 5, 2012.  Although these new procedures are part of the Government of Haiti’s efforts to become a Hague Adoption Convention partner, Haiti is not yet a party to the Convention.  The U.S. government will continue to process visas for adopted children under the non-Hague system until the Convention enters into force for Haiti.

IBESR has indicated that it plans to process adoption applications for which a completed file is submitted to IBESR prior to October 31* under current adoption procedures and cases filed on and after November 5* under the new procedures.  Since November 1-4 is a long holiday weekend in Haiti, IBESR’s offices will be closed those days.

Under the new procedures, IBESR plans to counsel the child’s biological parents and to obtain their pre-consent to adoption of their child.  This pre-consent will be a prerequisite of IBESR’s adoption authorization.  Prospective adoptive parents will likely be required to work with a U.S. Hague accredited adoption service provider that has been authorized by the Government of Haiti to participate in adoptions involving Haitian children.

Note that with the new procedures, IBESR plans to oversee matching of the child with the prospective adoptive parents.  These procedures may prohibit prospective adoptive parents – except in cases of intra-family adoptions – from establishing contact with the child they are seeking to adopt before they are officially matched to that child.  For further clarification on IBESR’s requirements, please work closely with your adoption agency or facilitator.*

COA's Latest Substantiated Complaint and Adverse Action Report

COA released an updated Substantiated Complaints and Adverse Action Report today, September 28, 2012. One agency, Vista Del Mar is listed as having an additional Substantiated Complaint since the publication of the last report in August 2012. No other new complaints appear in the report.

September 2012 Update to COA Substantiated Complaints and Adverse Action Report


In August of this year, PEAR published a list of agencies which had substantiated complaints under the COA's Hague Monitoring and Oversight provisions. The Council on Accreditation subsequently published a more recent collection of reports of Substantiated Complaints and Adverse Actions for Hague Accredited Agencies and Approved Persons. UPDATE: Kyrgyzstan - US Special Advisor for Children's Issues Travels to Kyrgyzstan

The following press release was made yesterday by the Office of Children's Issues. We are assuming this in response to the recent scandal in Kyrgyzstan involving misconduct by US adoption agencies and the subsequent suspension of their accreditation in Kyrgyzstan. We request the US DOS to disclose the identity of the agency alleged to have given bribes to the Kyrg Minister and that the DOS will ensure that the Counsel on Accreditation thoroughly and effectually deals with any agency who has participated in this scandal. The families who have been waiting for years to complete adoptions in Kyrgyzstan need the full assistance of ethical agencies. Further delays caused by the misconduct of US Hague accredited agencies are unconscionable.

Special Advisor for Children’s Issues Ambassador Susan Jacobs will visit Kyrgyzstan from August 13-15. As part of the State Department’s commitment to facilitating ethical and transparent intercountry adoptions, she will discuss the protection of children and the intercountry adoption process. This is the Special Advisor’s fourth trip to Kyrgyzstan to discuss these topics.
In 2008, Kyrgyzstan suspended intercountry adoptions, and many U.S. families who began the adoption process prior to the suspension are still waiting for their adoptions to be finalized. As part of her trip, Ambassador Jacobs will urge the Government of Kyrgyzstan to resolve these adoptions as quickly as possible, keeping the best interests of the children in mind. She will also meet with other organizations interested in child welfare issues.

UPDATE: Kyrgyzstan Reportedly Revokes Accreditation of All Foreign Adoption Agencies

According to media sources, the Kyrgyzstan government has revoked accreditation of intercountry adoption agencies. The order allegedly comes from the Ministry of Social Development and is translated as follows:


The order states: to terminate the force of accreditation certificates for international adoption of children without parental care of the following foreign organizations:
- Child and Future Agency (the Netherlands);
- Le Petit De Prince Interadop (Spain);
- L’ Airone Onlus Association (Italy);
- Love Basket Corporation (USA);
Another decision suspended (for up to two months of the current year) the accreditation certificates for international adoption of children without parental care of the following foreign organizations:
- Cuore Onlus Association (Italy);
- Adopta Association (Spain);
- In Cammino Per La Famiglia Onlus Association (Italy);
- Alliance des Fmilles du Québec Agency (Canada);
- Christian World Adoption Corporation (USA);
- Adekop Association (Spain).
The Ministry of Social Development has also suspended the order “On the commission on accreditation of foreign organizations for adoption children from the Kyrgyz Republic”.

Legislative Update: Universal Accreditation Introduced

Two identical bills were recently introduced, one in the House, one in the Senate, to amend the Intercountry Adoption Act, expanding the requirement for accreditation for all US adoption agencies offering intercountry adoption services. Both versions have been introduced and are now in Committee.

WASHINGTON, D.C. – Senate Foreign Relations Committee Chairman John Kerry (D-MA) and Ranking Member Richard Lugar (R-IN) along with Senators Mary Landrieu (D-LA)  and James Inhofe (R-OK) introduced legislation to elevate and standardize adoption services across the globe to safeguard against corruption and fraudulent adoptions.
After years of conflicting, country-by-country standards for Adoption Service Providers (ASPs), the Intercountry Adoption Universal Accreditation Act of 2012 will for the first time universalize the accreditation process for all ASPs.  The legislation would elevate standards, requiring all ASPs to comply with current, stronger requirements upheld for ASPs working with Hague countries.
The new accreditation standard would help safeguard against corruption and fraud in the adoption process. 
“The safety of children across the globe should be our number one concern in the adoption process and this commonsense reform will help us get them placed into safe and loving homes. Piecemeal, conflicting adoption standards have made far too many cracks and chasms in the system that left room for corruption, deception, and often outright fraudulent adoptions.  I’m grateful to our Ranking Member Dick Lugar and Senators Landrieu and Inhofe for partnering with me in this effort to elevate and put in place universal adoption standards that make kids the priority,” said U.S. Senator John Kerry (D-MA), Chairman of the Foreign Relations Committee.
“The United States adopts more children from overseas than any other nation.  Many of these children have serious medical conditions, often requiring significant and costly medical attention, yet, regardless, Americans open their hearts and homes to them.  This legislation establishes uniform standards that would provide American families with certainty that they are working with an accredited American adoption service provider, regardless of the country they are adopting from.  I am pleased to be joined by Senators Mary Landrieu and Jim Inhofe, two of the Senate’s leaders in this field, as well the Chairman of the Foreign Relations Committee, John Kerry,” said U.S. Senator Richard Lugar (R-IN), Ranking Member of the Foreign Relations Committee.
“Mandatory accreditation will ensure that the adoption process between the U.S. and other countries is lawful and safe for an adopted child and respectful of the families involved.  Additionally, I hope that this bill will prompt the U.S. Department of State to consider financially supporting the accrediting entities to relieve part of the financial burden on smaller agencies and to ensure a robust accreditation process,” said U.S. Senator Mary L. Landrieu (D-LA).
“Standardizing the accreditation process for international adoptions will provide additional protections for both the child and the adopting family.  The patchwork of adoption standards that currently exist have resulted in a situation that is not optimal for protecting the international children being offered for adoption.  It has also resulted in fraud and corruption that has devastated loving American families who are willing to make many sacrifices to adopt internationally.  This legislation is the right approach to fix the problems that currently exist,” said U.S. Sen. Jim Inhofe (R-OK), co-chair of the Congressional Coalition on Adoption.
The Intercountry Adoption Act of 2000 (IAA) specified that accreditation or approval is required in order to provide adoption services in cases subject to the Hague Convention with limited exceptions. The IAA defines the parameters of accreditation for the organizations providing services to prospective adoptive parents and charges the Department of State with responsibility of the accreditation process. The Kerry-Lugar bill would apply the accreditation requirement universally to all ASPs – those operating in both Hague and non-Hague countries.

Comment from PEAR: Universal Accreditation as a step in the right direction toward cleaning up intercountry adoption practices. Kyrgyzstan Investigating Allegations of Bribery in Agency Accreditation

According to news sources, Kyrgyzstan’s social development minister was arrested on Wednesday July 4, 2012 under suspicion of seeking at least $15,000 in bribes from a United States adoption agency. According to the media, the US agency had paid $10,000 in bribes to become accredited to participate in intercountry adoptions from Kyrgyzstan under the Hague, and the minister was seeking additional payments.

Notice: Agency Authorization Required by Romanian Law

The Romanian Office for Adoptions (the Office) reported to the U.S. Embassy in Bucharest that it will allow private non-profit organizations accredited in the foreign receiving country to transmit documents in intercountry adoption procedures provided that they are also authorized by the Office. U.S. accredited agencies that would like to work on behalf of U.S. prospective adoptive parents adopting children from Romania should submit a request for authorization to the Office with the following documents:
  1. A copy of all state statutes governing adoption service providers in the state where they are licensed;
  2. Domestic licenses and Hague accreditation documentation;
  3. Documents pertaining to the organizational and personnel structure;
  4. A history of the activities already performed, and recommendations from other collaborators, as well as from foreign authorities that supervise the agency’s work overseas;
  5. A description of planned activities and work methodology in Romania;
  6. A commitment to present to the Office only the applications of those families or individuals with whom the respective private organization has signed an agreement (contract, understanding) regarding the follow-up of the child after the adoption is granted by qualified personnel, for a period of at least two (2) years from the time the child enters the territory of the foreign state;
  7. A commitment to present to the Office annual activity reports, in view of the renewal of the authorization, as well as periodic reports, at its request;
  8. A commitment to forward to the Office quarterly reports for post-adoption follow-up required by the Office.

The Ministry of Education and Science, the Central Authority of Kazakhstan, has confirmed approval of two U.S. accredited adoption service providers (ASPs) to process Hague Convention adoptions from Kazakhstan to the United States.

The ASPs are:  Little Miracles and Across the World Adoptions. 

Approval of ASPs was the final step needed for Kazakhstan to complete its implementation of the Hague Adoption Convention.  Each of the U.S. ASPs approved by the Government of Kazakhstan may begin accepting applications for adoptions under the new procedures on its date of authorization. 
The U.S. Department of State is pleased to have the opportunity to work with Kazakhstan as a Hague Adoption Convention partner and to complete Convention intercountry adoptions of eligible children from Kazakhstan by qualified adoptive parents in the United States.

Suspension of Huminska's Anioly, Inc. lifted

The Council on Accreditation (COA) has announced that effective April 13, 2012 it has terminated the suspension of the Hague accreditation of Huminska's Anioly, Inc. that was imposed effective March 6, 2012. Huminska's Anioly, Inc. completed its corrective action plan to COA’s satisfaction and COA has determined that Huminska's Anioly, Inc. is now in substantial compliance with applicable U.S. accreditation standards. Huminska's Anioly, Inc. may resume providing adoption services in Hague Adoption Convention cases as of April 13, 2012.

Notice: Mexican Central Authority granted national authorization to an additional U.S. based Hague Accredited adoption service provider.

The Mexican Central Authority recently granted national authorization to provide adoption services in Mexico to an additional U.S. based Hague accredited adoption service provider, International Child Foundation. We remind U.S. citizens wishing to adopt in Mexico that Mexican states may choose whether or not to work with adoption service providers that have achieved national authorization. Please see our May 19, 2011 adoption notice regarding Mexico’s process for authorizing U.S. adoption service providers for more details. We advise prospective adoptive parents to check with the state child welfare office known as the Desarollo Integral de la Familia (DIF) in the Mexican state where they plan to adopt to determine if that state will work with a specific adoption service provider. We will publish additional updated guidance as we receive it.

Bulgarian MOJ Lists Accredited Mediators for Intercountry Adoption


The Bulgarian Ministry of Justice released a list of accredited organizations to mediate intercountry adoptions on June 20, 2011. PEAR recommends that prospective adoptive parents use only those agencies that are accredited under the US Hague Regulations (http://adoption.state.gov/hague_convention/agency_accreditation/agency_search.php) who work with one of the agencies accredited by the Bulgarian Ministry of Justice. We also highly recommend that prospective adoptive parents thoroughly research any agency before signing a contract. Notice: Adoption Service Providers Authorized in Mexico

The Mexican Central Authority (MCA) has provided the U.S. Central Authority (USCA) with information clarifying its process to authorize U.S.-based Hague accredited adoption service providers (ASPs) to provide adoption services in Mexico.

All prospective adoptive parents seeking to complete an intercountry adoption in Mexico must work with an ASP that has been authorized by a competent Mexican authority on either the national or state level. The national office of the Desarollo Integral de la Familia (DIF) provides national authorization of ASPs. In addition, state DIF offices do not have to recognize national authorizations and have the discretion to provide state-level authorizations to ASPs.

The MCA has informed us that, to date, only one ASP, Carolina Adoptions, has been authorized at the national level by national DIF. Twenty-nine Mexican states, plus the Federal District, have confirmed that they will accept Carolina Adoptions’ national authorization (please see the MCA state-by-state list provided).

The state of Jalisco does not accept Carolina Adoptions’ national authorization, but has authorized Across the World Adoptions to operate there. The state of Nuevo Leon indicates that it does not process intercountry adoptions.

Please note that because state DIF offices may authorize additional ASPs on a case-by-case basis, prospective adoptive parents (or their ASPs) must contact the DIF office in the relevant state to confirm whether a specific ASP has authorization, as well as provide USCIS, National Benefits Center, with proof of that authorization from the state level at the time of filing their case.

Please note that Carolina Adoptions has informed the USCA that due to its full workload of pending cases it is not able to take on new Mexican cases at this time. The National DIF informed us that several additional U.S.-based Hague Accredited ASPs are in process and pending authorization by the National DIF. As soon as we receive updated information we will publish additional public announcements.

The USCA will continue to work with the MCA to clarify how best to confirm that prospective adoptive parents are working with an authorized provider as authorizations continue to be granted at both the national and state levels, and more information will be provided at a later date.

Note from the Office of Children's Issues: The below list of U.S. Hague accredited adoption service providers that are authorized to provide intercountry adoptions services in Mexico was provided to our office in April 2011 by the national office of the Desarrollo Integral de la Familia (DIF). The information is subject to change. Prospective adoptive parents should verify this information with the national DIF before proceeding with an intercountry adoption.
